Sanitas Mundi - Subrogation ( health insurance )

After refunding expenses, the Insurer may exercise any rights and actions to which the Member may be entitled by reason of the claim with respect to the individual's responsible therefore, up to the amount of the indemnity paid.

The Insurer may not exercise the rights of the Member to which it succeeds in a manner that would be determined to the interests thereof. The Member shall be liable for any damages it may cause the Insurer by deed or omission with respect to the subrogated rights.

By law, the Insurer shall not be entitled to subrogation against any of the individuals whose deeds or omissions entail liability on the part of the Member, nor against any individual who caused the claim and is related to the Member by up to third-degree linear or collateral consanguinity or is an adoptive parent or adoptive child living with the Member. But such rule shall be null and void where liability is due to fraud or is covered by an insurance contract. In the latter case, the scope of subrogation shall be limited to the terms of the aforesaid contract.

In the event of concurrent claims by the Insurer and Member filed against a third party, the indemnity received shall be divided between the two in proportion to their respective interests.
